In a significant ruling, the Delhi High Court has declared Indian yoga guru Ramdev’s comments about “Sherbat Jihad” related to Rooh Afza as “indefensible.” This decision underscores the court’s commitment to promoting communal harmony and preventing divisive rhetoric.
During a hearing on Tuesday, Justice Amit Bansal stated that Ramdev’s remark was a shock to the court’s conscience. Earlier this month, Ramdev released a promotional video for Patanjali’s rose syrup, suggesting that a company selling Rooh Afza was involved in building mosques and madrasas. Rooh Afza has been a beloved drink for over a century in both Pakistan and India. Ramdev’s remarks ignited a wave of backlash, prompting Hamdard, the company that produces Rooh Afza, to file a petition in court requesting the removal of his video from social media platforms.
Senior lawyer Mukul Rohatgi, representing Hamdard, described Ramdev’s comments’Sherbat Jihad’ as shocking and stated they not only demean Rooh Afza products but also promote “communal division.” He likened Ramdev’s comments to hate speech. Rohatgi defended Patanjali, stating it is a reputable brand that should compete without disparaging others.
Interestingly, Rohatgi had also previously represented Patanjali’s founders in a case involving claims about a COVID-19 treatment.
Later in court, a proxy lawyer for Ramdev requested a postponement due to the absence of the main lawyer. Justice Bansal insisted that the main lawyer must appear by midday or face a “very strong order.”
Ultimately, Ramdev’s lawyer Rajeev Nair appeared and announced that Ramdev would withdraw any advertisements against Hamdard. The court has ordered Ramdev to submit an affidavit stating he would not make comments or social media posts about Rooh Afza that could harm Hamdard’s reputation. This affidavit is required within a week, with the next hearing scheduled for May 1.
