Asian Woman Denies Returning Mistakenly Transferred 6,000 Dirhams

In Dubai, the Civil Court has ordered an Asian woman to return 6,000 Dirhams mistakenly transferred to her account and to pay a compensation of 5,000 Dirhams.

According to Emarat Al Youm, a private company employee filed a lawsuit stating that 6,000 Dirhams were mistakenly deposited into the woman’s account. Despite multiple attempts to contact her, she initially delayed and later refused to return the money.

The plaintiff argued that he was a low-level employee earning only 4,000 Dirhams monthly and could not afford such a loss. If he were to deduct that amount from his salary, it would cause him significant financial hardship.

The Civil Court began hearing the case, examining all evidence and bank deposit slips. It decided that the Asian woman must return the amount mistakenly transferred and pay a fine of 1,000 Dirhams.

The initial court order was upheld by the Court of Appeal, but the woman still refused to comply with the court’s ruling. After six months of silence and non-compliance, the case was taken up by the Criminal Court.

The Criminal Court, noting her continued refusal to obey the court’s decision over a long period, concluded that the plaintiff had suffered mental anguish during this time. Thus, in addition to the original 6,000 Dirhams, the court ordered her to pay an extra 5,000 Dirhams as compensation for the mental harm caused.

This case highlights the legal process in UAE regarding mistaken financial transfers and the strict consequences for refusing to comply with court orders, especially when it causes mental and emotional distress.
